Terms of Service
These Terms of Service ("Terms") govern access to and use of the Can't Stop the Growth ("CSTG") workforce training platform at app.cstgtraining.com and any related services. By accessing or using the platform you agree to these Terms. The platform is operated by Cant Stop the Growth [CONFIRM FULL REGISTERED LEGAL NAME AND ENTITY TYPE], 656 S. Graham Rd., Greenwood, IN 46143, United States.
1. Accounts and eligibility
CSTG is a business platform for home-services contractors. You must be at least 18 years old to use it. Most accounts are provisioned by a company that subscribes to CSTG for its employees; where that is the case, the subscribing company administers the account, decides who may access it, and may view, modify, suspend or delete it and the training records associated with it.
You are responsible for keeping your credentials confidential and for activity under your account. Notify us promptly at danny@cantstopthegrowth.com of any unauthorized use.
2. Acceptable use
You agree not to:
- share account credentials, or access the platform on behalf of someone whose account it is not;
- copy, download, redistribute, resell or publicly post training content except as the platform expressly allows;
- upload unlawful, infringing, harassing or malicious content, or malware;
- probe, scan, overload, reverse engineer or attempt to gain unauthorized access to the platform or its underlying systems;
- use automated means to scrape or extract data from the platform without our written permission;
- use the platform in violation of applicable law or of your employer's policies.
3. Subscriptions and access
Access to CSTG is provided under a subscription between CSTG and the subscribing company. Fees, term, seat counts, renewal and payment terms are set out in that company's order form or subscription agreement, which governs in the event of a conflict with these Terms on those subjects. Access continues for the paid term and ends when the subscription ends or is suspended for non-payment. [CONFIRM BILLING, RENEWAL AND REFUND TERMS]
We may modify or discontinue features. We aim to give reasonable notice of material adverse changes to subscribing companies. [CONFIRM ANY SERVICE-LEVEL OR UPTIME COMMITMENT — OMIT IF NONE]
4. Intellectual property in training content
The platform, its software, and all CSTG-authored curriculum, learning tracks, career maps, assessments, videos, documents and other training materials are owned by CSTG or its licensors and are protected by intellectual-property law. Subject to these Terms and an active subscription, we grant the subscribing company and its authorized users a limited, non-exclusive, non-transferable, revocable license to access and use that content for internal training purposes only.
Content that a company or its users upload to the platform remains the property of that company or user; they grant CSTG a license to host, process and display it as needed to operate the platform. Feedback you send us may be used without restriction or obligation.
5. Third-party integrations
CSTG offers optional integrations with third-party services, including Google Calendar and Microsoft Outlook. Connecting an integration is your choice. Your use of those services is governed by their own terms and privacy policies — including the Google Terms of Service and the Microsoft Services Agreement — and we are not responsible for third-party services, their availability, or changes they make to their APIs. What CSTG accesses through these integrations and how to revoke access is described in our Privacy Policy. [CONFIRM ANY OTHER INTEGRATIONS TO LIST]
6. Disclaimers
The platform and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure or error-free. CSTG training content is general instructional material for the trades; it is not a substitute for licensure, code compliance, manufacturer instructions, employer safety procedures, or professional judgment. You remain responsible for the safe and lawful performance of any work.
7. Limitation of liability
To the maximum extent permitted by law, CSTG and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the platform, whether in contract, tort or otherwise, even if advised of the possibility. Our total aggregate liability for all claims relating to the platform will not exceed the amounts paid to CSTG for the platform in the [TWELVE (12)] months preceding the event giving rise to the claim. [CONFIRM LIABILITY CAP AND ANY CARVE-OUTS]
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
8. Termination
A subscribing company may terminate as provided in its subscription agreement. We may suspend or terminate access, with notice where practicable, if these Terms are breached, if use creates risk to the platform or other users, or if fees go unpaid. On termination, the license in section 4 ends and access to the platform stops. Data export and deletion after termination are handled as described in the Privacy Policy. [CONFIRM POST-TERMINATION DATA EXPORT WINDOW]
9. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION — e.g. the State of Indiana, USA], without regard to conflict-of-law rules. The parties submit to the exclusive jurisdiction of the courts located in [VENUE — e.g. Johnson County, Indiana]. [CONFIRM WHETHER ARBITRATION AND CLASS-ACTION-WAIVER TERMS APPLY]
10. Changes to these Terms
We may update these Terms. We will revise the effective date above and notify subscribing companies of material changes. Continued use after changes take effect constitutes acceptance.
